Intel on Thursday landed a crucial victory in a private lawsuit that accused it of unfair pricing [sub. required]. Special Master Vincent Poppiti recommended to the US District Court in Delaware that the judge deny the lawsuit any class action status as there was no proof PC shoppers as a group were price gouged by alleged Intel price dumping meant to exclude AMD from the market. As Intel only set its own pricing, computer builders were free to drop their own stickers rather than simply widen their profit margins, Poppiti said.

As if Apple didn’t have enough trouble dealing with iPhone 4 at the moment, now some users are starting to complain about the iPad. More specifically, a class action lawsuit has been started for the iPad apparently overheating.
The problem stems from trying to use the iPad outside when it is hot. The lawsuit claims that the iPad does not live up to expectations as when it overheats a message appears telling the user to let the device cool down before using it again. It is therefore unusable in certain situations according to the three users who started the lawsuit.

Late last week, Wired reported that a lawsuit filed against Apple and AT&T over the carrier’s exclusivity arrangement for the iPhone has received class action status, meaning that it now automatically covers every iPhone customer in the United States.
In an interview Friday with Wired.com, Mark Rifkin, lead counsel representing the plaintiffs of the suit, highlighted that the terms of AT&T’s two-year customer contract say that customers have the option to terminate whenever they wish for a fee to switch to another carrier.

A California law firm has asked iPhone 4 customers to share their experiences with reception on Apple’s new handset, laying the groundwork for a potential class-action lawsuit.
